Your Agreement to these Terms and Conditions for availing Service The Terms and Conditions (as may be amended from time to time, the “Agreement”) is a legal contract between you being, an individual customer, user, or beneficiary of this service of at least 18 years of age, and smtpocean.com. Hence all the rights, benefits, liabilities & obligations under the following terms & conditions shall accrue to the benefit of smtpocean.com. (together with its subsidiaries and other affiliates, “us”, “We” or “Smtpocean”), regarding your use of our Servers or Services regarding Email marketing or such other services which may be added from time to time (all such services are individually or collectively are referred as Service or Services as they case may be). Service can be used by you subject to your adherence with the terms and conditions set forth below including relevant policies. Smtpocean.com reserves the right, at its sole discretion, to revise, add, or delete portions of these terms and conditions any time without further notice. You shall re-visit the “Terms & Conditions” link from time to time to stay abreast of any changes that the “Site” may introduce.

The services are not available to persons under the age of 18 or to anyone previously suspended or removed from the services by Smtpocean.com. By accepting these Terms & Conditions or by otherwise using the Services or the Site, You represent that You are at least 18 years of age and have not been previously suspended or removed from the Services. You represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity.

We provide business and web site operators a software application to create, launch, and manage online email campaigns and newsletters. The Service must not be used for the sending of unsolicited email (sometimes called “spam”).

“ All services provided by us( Smtpocean.com) are unmanaged services. Thus we reserve the right to grant or not privilege access to the servers to any of our clients in all conditions. All requests regarding access to the server rather than the application access will not be entertained & are denied by default.”

All Services provided by us are subject without limitation to our Privacy Policy and our Anti-Spam Policy. We may modify the terms of the Agreement and may discontinue or change any aspects of the Services at its sole discretion. Any changes to the application or the terms and conditions become effective upon those changes being made live on the website.

Monthly subscriptions are billed monthly, in advance, according to the Fee Schedule selected by you at sign up. Subscription date will start from the Date of Product/ Service order. subscription date will not be altered due to any delay in Setup. In the event that monthly subscription fees are changes, your fee will remain at the level at which you signed up.

If any person referred by any third party then he should Discuss in details with our service support/ Chat Support before any purchase. We’ll not be responsible for any Third party commitment.

Payment can be made to us by Paypal or other processing system we desire. If you take a monthly subscription, you are authorizing us to charge your credit card a set amount on a regular basis. The date upon which the charge will be levied is the monthly renewal date of your Subscription. If we are for any reason unable to deduct the monthly payment from your credit card, you will be notified via email and your account will be suspended until payment is received.

Refund Policy – Your access may be suspended at any time with or without cause. If we terminate you without cause, we will refund a Pro Rata portion of your monthly subscription. If we terminate you for cause, there will be NO REFUND for any fees paid. Cause is any violation of our anti-spam or privacy policy, such as your using our services to send bulk Emails to people who have not consented to receiving them or sending to a list that hasn’t been used for more than 12 months or Bounce rate is more than 15%.  In addition, you are responsible for canceling your account and we will offer no refund for your failure to cancel your account. When an account is terminated by us or cancelled by the client, we reserve the right to remove any emails and related data and files.

Restrictions and Responsibilities

We reserves all rights other than those expressly granted in this Agreement, and no licenses are granted except as expressly set forth herein.

You will not contest the validity with regard to trademarks or other brand features or content during the term of this Agreement, or after the expiration of this Agreement.

Also rights would be reserved to remove any content or immediately suspend use, if it believes that use is:

1) Violation of any national or international laws.

2) Constitutes pornography, Nudes & Semi Nudes.

3) Excessively violent or contains harassing content or hate speech.

4) Improperly exposes trade secrets or other confidential information of another person.

5) Malicious, Fraudulent, or may result in retaliation against us by offended recipients.

Mention of “unsubscribe” link & “Company address” are mandatory to all outgoing email which will allow visitors to remove themselves from your mailing list.

Your customer information will not be shared with any other parties, unless required under law. We will not use your customer information for the purpose of sending unsolicited commercial e-mail. We may use this information and any technical information about your use of the Services to facilitate your use of communications with you.

You will comply with our Privacy Policy and the Anti-Spam Policy, which may be modified by us from time to time.

Termination

This Agreement will have a term beginning on the payment date of the first monthly subscription or on the payment date of the first purchase of any Plan. You may terminate this Agreement at any time by following the cancellation instruction available from within the application or by sending an email to support desk ( care@smtpocean.com ).

We may immediately terminate this Agreement and suspend the access without refund if you are in violation of any of terms outlined in this agreement. Smtpocean.com is not liable for any commercial damage to you as a result of it’s decision to terminate or suspend your account.

Also we reserve the right to delete any account data within 48 Hours after Due Date.
